1. Introduction:
Welcome to Emily Griffis Art!
I'm truly honored you're here and grateful that you're considering me to help capture your special memories in watercolor. It means so much to be part of your meaningful moments. Before we get started, please take a moment to review the terms outlined below.

2. Our Services:
At Emily Griffis Art, each painting is more than brushstrokes—it’s a tribute to the spirit of its subject. I welcome your stories, memories, and photos to help bring that essence to life.
While I value your input and aim to reflect your vision, final artistic decisions rest with me, ensuring the piece stays true to its creative heart.
It is important to remember that the final result is an artistic interpretation, not a photographic replica.

3. Pricing and Payment:
-Pricing Structure: Our pricing is flexible and based on things like the size of the piece, the level of detail, and any special requests you might have.
-Special Requests: If your desired commission has unique requirements not explicitly addressed on my website, these will be discussed and negotiated on individually.
- Waiting List: To secure a position on our waiting list, we require full payment in advance. This ensures commitment from both parties and allows me to focus on crafting your masterpiece.

4. The Artistic Journey:
- Waiting List: Once your payment is processed, you will be added to my waiting list.
- Progress Updates: I’ll keep you in the loop with a quick update when your piece begins and another as it nears completion—because your excitement matters!
- Delivery: Upon finishing, artworks are carefully packaged for shipping. While I do my best to prepare packages for shipping, I am unable to control how the package is handled or delivered once it is in transit.

5. Revisions and Refunds:
- The Nature of Watercolors: Watercolor is a beautifully fluid and expressive medium, but it also has its quirks and limitations. To honor the integrity of the piece, I’m able to offer one thoughtful revision to help ensure it feels just right.
- Client Satisfaction: I truly want you to love your artwork. If, after the included revision, it still doesn’t feel like the right fit, I offer a 50% refund as a gesture of understanding. Emily Griffis Art retains the rights to the piece and may choose to display, archive, or resell it in the future.

- Digital products are not eligible for refund once the files have been delivered to the client.

6. Copyright and Usage:
- Ownership: The intellectual property of the artwork, represented by its copyright, remains with Emily Griffis Art.
- Personal Usage: Your commissioned artwork is to be used for personal use only.
- Digital Products: If digital products are purchased, they are only to be used for personal use. Any commercial use, reproduction, or resale is strictly prohibited.

7. Disclaimers and Warranties:
All services and artworks provided by Maya's Art Studio come "as is." We do not offer any explicit or implicit warranties or guarantees regarding the durability, longevity, or any other aspect of the artworks.

8. Indemnification:
Clients agree to defend, indemnify, and hold harmless Emily Griffis Art, its affiliates, and their respective directors, officers, employees, and agents from any claims, liabilities, costs, and expenses, including, but not limited to, attorneys' fees, arising in any way from their misuse of the commissioned artwork or breach of these terms.

9. Limitation of Liability:
While every artwork is handled with care, Emily Griffis Art is not responsible for damages incurred during shipping or the natural aging process of the materials used in the artwork.

10. Termination of Service:
Emily Griffis Art reserves the right to cease providing services to any client, especially if they fail to adhere to these terms or exhibit behavior that we deem inappropriate or harmful.

11. Force Majeure:
In the event of unforeseen circumstances beyond our control, such as natural disasters, pandemics, or other "acts of God," Emily Griffis Art will not be held liable for delays or failures in performing its obligations.

12. Refund Policy:
- While we offer a 50% refund under specific conditions, any other scenarios warranting a refund will be considered on a case-by-case basis.

- Digital products are not eligible for refund once the files have been delivered to the client.
